Incompatibility regulations for public office holders in the Dutch Caribbean

Oral presentation by Brechtje Huiskes: Incompatibility regulations for public office holders in the Dutch Caribbean

My PhD research focusses on integrity supervision of public office holders in Small Island States. This contribution analyzes the incompatibilities regulations ("incompatibiliteitenregelingen") which have been laid down in the constititutions of Aruba, Curacao, the Netherlands and Sint Maarten, and in the legislative frameworks pertaining to the governance of the Dutch municipalities and the BES-islands. An example of an incompatibility regulation is that a Minister may not concurrently hold the office of parliamentarian.

While these regulatory regimes exhibit notable similarities, they are not uniform. This project aims to :

1. systematically identify and explain the differences between these incompatibility regimes; and

2. critically evaluate the extent to which the existing incompatibility regimes in the Dutch Caribbean adequately incorporate the contextual factors of post-colonialism, limited sovereignty, small-scale governance, and the unique dynamics of islandness.

By adopting a comparative legal and governance perspective, this study seeks to contribute to the broader discourse on integrity, accountability, and institutional design in small island jurisdictions.

Preferred type of presentation: oral.

If it is not possible to accomodate an oral presentation, I would be open to a poster presentation.
